BARRACKS LEGEND FOUNDATION

EVENT PARTICIPATION, RELEASE OF LIABILITY, ASSUMPTION OF RISK,

INDEMNIFICATION, AND PHOTO/VIDEO RELEASE AGREEMENT

This Agreement is entered into between Barracks Legend Foundation (“Foundation”) and the

undersigned individual (“Participant”) in connection with participation in Foundation-sponsored

events, programs, activities, or transportation, whether occurring on or off Foundation premises.

1. Voluntary Participation and Acknowledgment

Participant acknowledges that participation in Foundation activities is voluntary. Participant

understands that activities may involve physical, emotional, environmental, transportation-related, or other risks inherent in group events, outdoor activities, travel, or interaction with

others.

Participant affirms that they are physically and mentally able to participate and agree to follow

all Foundation rules, safety instructions, and staff or volunteer direction.

2. Assumption of Risk

Participant knowingly and voluntarily assumes all risks, known and unknown, foreseeable and

unforeseeable, arising out of or related to participation in Foundation activities, including but not

limited to:

• Physical injury or illness

• Emotional or psychological distress

• Property loss or damage

• Transportation-related incidents

• Environmental or weather-related risks

• Acts or omissions of other participants or third parties

3. Release and Waiver of Liability

To the fullest extent permitted by law, Participant releases, waives, and forever discharges

Barracks Legend Foundation and its officers, directors, board members, employees, volunteers,

agents, representatives, contractors, partners, sponsors, and affiliates from any and all claims,

demands, damages, causes of action, or liabilities, whether known or unknown, arising out of

or related to participation in Foundation activities, including claims based on negligence.

4. Indemnification

Participant agrees to indemnify, defend, and hold harmless the Foundation and its

representatives from any claims, losses, damages, costs, or expenses, including reasonable

attorneys’ fees, arising from Participant’s actions, conduct, or participation, including claims

brought by third parties.

5. Photo, Video, and Media Release

Participant grants the Foundation the irrevocable, perpetual, royalty-free, worldwide right to

photograph, record, use, reproduce, publish, distribute, display, edit, and create derivative works

from photographs, video recordings, audio recordings, or other media that include Participant’s

image, likeness, voice, name, or identifying characteristics.

Media may be used for any lawful purpose consistent with the Foundation’s mission, including

marketing, fundraising, education, training, digital and social media, internal communications,

and archival purposes.

6. Ownership and No Compensation

Participant acknowledges that all media is the exclusive property of the Foundation.

Participant waives any right to inspect or approve the finished product and understands that no

compensation or royalties will be provided.

7. No Obligation and Irrevocability

The Foundation has no obligation to use any media. This Agreement is irrevocable, and

Participant acknowledges that once media is published or distributed, it may not be possible to

retract or remove it.

8. Minors

If Participant is under eighteen (18) years of age, a parent or legal guardian must sign below. The

parent or guardian represents that they have full legal authority to consent on behalf of the minor

and agree to all terms of this Agreement.

9. Governing Law and Severability

This Agreement shall be governed by and interpreted in accordance with the laws of the State of

Florida. If any provision is found invalid or unenforceable, the remaining provisions shall

continue in full force and effect.

10. Acknowledgment

Participant acknowledges that they have read this Agreement in full, understand its terms, and

sign it voluntarily and without coercion.
